NOTICE TO ALL USERS: PLEASE READ THIS EULA CAREFULLY, AS IT CONSTITUTES THE LEGAL AGREEMENT BETWEEN YOU AND JyotAI.
Please read the terms and conditions of this End User License Agreement ("EULA", "Agreement") carefully before you use the JyotAI ("Software"). By installing the Software or using the Software, you accept all the terms and conditions of this EULA on behalf of yourself and any entity or individual you represent. If you do not agree with the terms and conditions of this EULA, please do not use the Software. Please also refer to the JyotAI Terms of Use and JyotAI Privacy Policy.
JyotAI is owned and operated by Wartraf sp. z o.o. ("JyotAI," "us," "we," or "our"), a legal entity incorporated under the laws of Poland, having its registered office at ul. Straganiarska, 20-22/35, Gdańsk, 80-837, Poland.
JyotAI may revise this Agreement at any time at our sole discretion and the revised Agreement shall automatically apply to the corresponding versions of the JyotAI distributed with the revised terms.
JyotAI grants you a personal, non-exclusive, non-transferable, non-sublicensable, limited, and revocable license to download, install, and use the JyotAI Software ("License") strictly in accordance with the terms of this Agreement, Terms of Use, and Privacy Policy. This license allows you to use JyotAI Software exclusively for personal, non-commercial use. We reserve all other rights to the JyotAI Software.
You are only allowed to access the Software through the interfaces and protocols provided or authorized by JyotAI. You agree that you will not access the Software through unauthorized means, such as an unlicensed software client.
If you intend to utilize the Software for any commercial purpose, including on behalf of a business or organization, you must enter into a separate written agreement with us beforehand. To explore such arrangements, please contact dev@wartraf.com for more details.
The Software is protected by copyright and other intellectual property laws, and all intellectual property rights in and to the Software belong to JyotAI. Further, all right, title and interest, including all intellectual property rights, in and to the content which may be accessed through use of the Software is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This Agreement grants you no rights to use such content. All rights not expressly granted to you are reserved by JyotAI. The Software is only licensed to you, not sold. You must comply with all applicable laws regarding use of the Software.
You may not reproduce, publish, transmit, modify, create derivative works from, publicly display, or publicly perform the Software. Copying or storing the Software other than as expressly permitted is prohibited unless you obtain prior written permission from JyotAI. You may not remove or alter any copyright notices on any copies of the Software. You may not rent, lease or otherwise transfer the Software. Unless permitted by law, you may not reverse engineer, decompile, or disassemble the Software or attempt to do so.
In order to optimize the Software, and to provide you with the most current version of the Software, you agree the Software may download and install new updates and versions of the Software as they are made available by us.
JyotAI may offer technical support features during the Software license term, such as assistance through email or other methods. Technical support is provided at JyotAI discretion, without any guarantees or warranties. It is solely your responsibility to complete a backup of all your existing data, software and programs before receiving any technical support. While providing the technical support, we may determine that the technical issue is beyond the scope of the technical support. We reserve the right to refuse, suspend or terminate any of the technical support.
The Software may include third-party features and functionalities or may allow you to access content on a third-party website. Such features, functionalities or content may be subject to third-party terms of service and privacy policies. Always review the specific license terms applicable to any bundled third-party software for more details. You acknowledge sole responsibility for and assume all risk arising from your use of any third-party resources.
You are authorized to install and operate the JyotAI Software on your devices. However, you are solely responsible for procuring and maintaining, at your own cost, all necessary hardware, software, internet access, and communication networks required to utilize the Software. JyotAI will not be held accountable for any delays or failures in the Service caused by issues with equipment, software, internet connectivity, or communication networks that fall outside of our control.
JyotAI PROVIDES THE SOFTWARE "AS IS" AND WITHOUT ANY WARRANTIES, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SOFTWARE WILL MEET YOUR EXPECTATIONS OR FUNCTION WITHOUT INTERRUPTION OR ERRORS. WE DO NOT GUARANTEE THE SOFTWARE IS FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. YOU ASSUME ALL RISKS ASSOCIATED WITH USING THE SOFTWARE, INCLUDING ANY DATA LOSS OR ERRORS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JyotAI DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT WILL WE OR ANY OTHER PARTY WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, DISTRIBUTION, PROMOTION, OR MARKETING OF THE SOFTWARE BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY SPECIAL, INDIRECT, INCIDENTAL, RELIANCE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, LOSS OF DATA OR PROFITS, OR FOR INABILITY TO USE THE SOFTWARE, EVEN IF WE OR SUCH OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SUCH LIMITATION SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND TO THE FULLEST EXTENT PERMITTED BY LAW. IN NO EVENT, SHALL OUR AGGREGATE LIABILITY TO YOU AND ANY OTHER PARTY, WHETHER DIRECT OR INDIRECT, EXCEED THIRTY DOLLARS ($30.00) FOR ANY AND ALL CLAIMS, DAMAGES, AND OTHER THEORIES OF LIABILITY.
This Agreement is governed by the laws of Poland and international copyright laws and treaties, without considering conflict of law principles. Any disputes related to this Agreement shall be resolved exclusively in the courts of Poland.
This Agreement represents the complete understanding between you and JyotAI, replacing any prior agreements, communications, or understandings—whether written or oral—concerning its subject matter. If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain valid and enforceable.
This EULA becomes effective upon your first use of the Software and remains in effect until terminated. JyotAI reserves the right to terminate, suspend or otherwise restrict your access to the Software with or without notice at any time for any reason. In addition, JyotAI reserves the right to modify or discontinue the Service or any portion hereof at any time with or without notice.
You may terminate your relationship with us at any time by completely uninstalling the Software.
