NOTICE TO ALL USERS: PLEASE READ THIS AGREEMENT CAREFULLY, AS IT CONSTITUTES THE LEGAL AGREEMENT BETWEEN YOU AND JyotAI.
Thank you for choosing JyotAI. For the purposes of this Terms of Service (the "Terms") "JyotAI", "We" or "Us" means Wartraf sp. z o.o., address: ul. Straganiarska, 20-22/35, Gdańsk, 80-837, Poland.
You agree to be bound by these Terms by either: 1) using and/or accessing the JyotAI application (the "App"); 2) using and/or accessing our website located at https://jyot-astrology.com/ (the "Website"), collectively referred to as the "Service", or otherwise electronically agreeing to be bound to these Terms.
If you do not agree to any part of these Terms, please refrain from using our App or Website.
You are not permitted to use or access the Service if you are unable to enter into a legally binding agreement with JyotAI. You affirm that you are at least eighteen (18) years old and possess the legal capacity, rights, and authority to agree to these Terms in their entirety. You also confirm your ability to fulfill all obligations and comply with the rules, conditions, and assurances stated herein.
Within the limits of applicable law, JyotAI reserves the right to review and change these Terms at any time. As long as you are using the Service, you are responsible for regularly reviewing these Terms. Continued use of the Service, including non-deletion of your Account after such changes are performed shall constitute your consent to them. The latest Terms will apply going forward and to any dispute or issue arising after the Terms have been updated.
JyotAI provides tools for self-awareness, emotional journaling, breathing exercises, and astrology-based tips. It is meant for personal, non-professional use only and does not offer medical or therapeutic advice.
The Application is available free of charge with optional paid features offered through a subscription model.
Paid Features: Access to premium functionality is provided under a paid subscription plan. Users may choose a subscription for a weekly, monthly, or yearly term.
Trial Period: A free 3-day trial is available for new users. After the trial period ends, the selected subscription plan will automatically renew unless canceled before the end of the trial.
Automatic Renewal: Subscriptions automatically renew for the same period as the original plan (weekly, monthly, or yearly) unless canceled at least 24 hours before the current period ends. Renewal charges will be applied to the payment method associated with your account.
Payment Processing: Payments and renewals are processed through the platform provider (Apple App Store). By confirming the purchase, you agree that your payment will be charged to your App Store account.
Refunds: Refunds may be issued in accordance with the refund policies of the respective platform (Apple App Store). If you believe you were charged in error or wish to request a refund, please follow the official refund request procedure provided by the platform.
To use certain features of our Service, you may be required to create an account ("Account"). By creating an Account, you agree to provide truthful and accurate information during registration and keep your information updated to maintain its accuracy.
You are responsible for all activity associated with your Account, including any actions taken by others who access it, whether authorized or not. If you become aware of any unauthorized use of your Account, email address, or password, please notify us immediately.
By using our Service, you agree not to:
JyotAI may, from time to time, change the Service and any aspect or feature of the Service if considered necessary for security or legal reasons, to ensure the operability of the Service, to reflect advancements in technology or to enhance the features we are able to offer our customers. You hereby consent to automatic updates to the Service. Any such updates or upgrades will be considered part of the Service and will be governed by these Terms.
JyotAI alone shall own all right, title and interest, including all related intellectual property rights, in and to our technology, the content and the Service and any suggestions, ideas, enhancement requests, feedback, recommendations or other information provided by you or any other party relating to JyotAI. The company name, the company logo, and the product names associated with JyotAI are trademarks of Wartraf sp. z o.o. or third parties, and no right or license is granted to use them. The copying, redistribution, use or publication by you of any such matters or any part of the JyotAI is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through JyotAI.
JyotAI grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable, non-assignable, and time-limited license (the "License") to download, install, and use the App on a compatible device that you own or control for personal, non-commercial purposes only.
For commercial use of the Service please contact us at dev@wartraf.com to discuss licensing options. Any unauthorized commercial use is prohibited and will be considered a violation of these Terms.
Third party content may appear within the Service or may be accessible via links. Any such activity, and any terms, conditions, warranties or representations associated with such activity, is solely between you and the applicable third-party. JyotAI and its licensors shall have no liability, obligation or responsibility for any such correspondence, purchase or promotion between you and any such third-party. We do not endorse any sites on the Internet that are linked through JyotAI (unless otherwise stated), and in no event shall JyotAI or its licensors be responsible for any content, products, or other materials on or available from such sites. We recommend reviewing the terms and privacy policies of any third-party content you interact with.
Your privacy is important to us. JyotAI will collect, use and transfer your personal information in accordance with the terms of our Privacy Policy, which is incorporated herein by reference and can be found here.

JyotAI reserves the right to terminate, suspend or otherwise restrict your access to the Service with or without notice at any time for any reason. In addition, JyotAI reserves the right to modify or discontinue this Service or any portion hereof at any time with or without notice.
You may terminate your relationship with us at any time by completely uninstalling the App.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, (1) THE SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, AND (2) JyotAI FOR ITSELF AND ITS LICENSORS EXPRESSLY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, JyotAI MAKES NO WARRANTIES THAT: (I) THE SERVICES WILL MEET YOUR REQUIREMENTS; (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; (IV) THE QUALITY OF ANY SERVICES OR INFORMATION OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS; OR (V) ANY ERRORS IN THE SERVICE WILL BE CORRECTED. IN ADDITION, JyotAI MAKES NO REPRESENTATION OR WARRANTY ABOUT ANY THIRD-PARTY PRODUCTS.
UNDER NO CIRCUMSTANCES WILL JyotAI OR ITS AFFILIATES, CONTRACTORS, EMPLOYEES, AGENTS, OR THIRD-PARTY PARTNERS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, RELIANCE, OR EXEMPLARY DAMAGES (INCLUDING WITHOUT LIMITATION DAMAGES ARISING FROM ANY UNSUCCESSFUL COURT ACTION OR LEGAL DISPUTE, LOST BUSINESS, LOST REVENUES, OR LOSS OF ANTICIPATED PROFITS OR ANY OTHER PECUNIARY OR NON-PECUNIARY LOSS OR DAMAGE OF ANY NATURE WHATSOEVER) ARISING OUT OF OR RELATING TO THIS AGREEMENT OR THAT RESULT FROM YOUR USE OF OR YOUR INABILITY TO USE THE SERVICE, OR ANY OTHER INTERACTIONS WITH JyotAI.
SUBJECT TO APPLICABLE LAWS IN YOUR JURISDICTION, YOU WILL INDEMNIFY AND HOLD HARMLESS JyotAI AND ITS AFFILIATES (AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS) HARMLESS FROM ANY CLAIMS, DEMANDS, LIABILITIES, DAMAGES, LOSSES, COSTS AND EXPENSES, INCLUDING, WITHOUT LIMITATION, REASONABLE ATTORNEYS' FEES, ARISING OUT OF YOUR BREACH OF THESE TERMS, OR YOUR VIOLATION OF ANY LAW OR REGULATION, OR OF THE RIGHTS OF ANY THIRD PARTY, IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE.
This Agreement (including the items incorporated by reference and modifications that may be made from time to time by JyotAI), constitute the entire agreement between JyotAI and you regarding the Services, and supersedes all prior agreements between you and JyotAI regarding the subject matters hereof. Any references that are singular or plural and any references that are masculine, feminine, or neutral in gender, are meant to be used interchangeably as the context of the sentence might imply.
If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision will be limited or eliminated from this Agreement to the minimum extent necessary and will not affect the validity and enforceability of any remaining provisions.
This Agreement is governed by the laws of Poland and international copyright laws and treaties, without considering conflict of law principles. Any disputes related to this Agreement shall be resolved exclusively in the courts of Poland.
